Terms of Service

1. Introduction

Welcome to Has the Dog Pooped? ("the Service", "we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms constitute a legally binding agreement between you ("User", "you") and the operator of the Service, a private individual established in Finland. The Service is intended for personal, non-commercial use to track a dog's bathroom and feeding events.

2. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement. If you are under 18, you confirm that you have obtained permission from a parent or legal guardian.

3. Account and Access

Access to certain features of the Service requires authentication via a third-party identity provider (Google). You are responsible for maintaining the confidentiality of your account and for all activities that occur under it. You agree to notify us immediately of any unauthorised use of your account.

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable local, national, or international law or regulation;
  • Transmit any unsolicited or unauthorised advertising or promotional material;
  • Introduce viruses, malware, or other harmful material;
  • Attempt to gain unauthorised access to any part of the Service or its infrastructure;
  • Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service.

5. User Content

You may submit notes and other content when logging events ("User Content"). You retain ownership of your User Content. By submitting User Content, you grant us a limited licence to store and process it solely for the purpose of providing the Service to you.

You are solely responsible for your User Content and must ensure it does not infringe any third-party rights or violate any applicable laws.

6. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of the operator and its licensors. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

7. Privacy and Data Protection

We process personal data in accordance with the EU General Data Protection Regulation (GDPR) (Regulation (EU) 2016/679). By using the Service, you acknowledge that we collect and process personal data as described in our Privacy Policy (where applicable).

If you believe your data protection rights have been violated, you have the right to lodge a complaint with the Finnish Data Protection Ombudsman (Tietosuojavaltuutetun toimisto) at tietosuoja.fi, or with the supervisory authority in the EU member state where you reside.

8. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

9. Limitation of Liability

To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the Service, even if we have been advised of the possibility of such damages.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under applicable EU law.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Finland, without regard to its conflict of law provisions.

If you are a consumer resident in the EU, you also benefit from any mandatory consumer protection provisions of the law of the country in which you reside. Any dispute arising from these Terms shall first be attempted to be resolved amicably. If unresolved, Finnish consumers may refer the dispute to the Consumer Disputes Board (Kuluttajariitalautakunta) at kuluttajariita.fi. Before filing a complaint, you should contact the Consumer Advisory Services (Kuluttajaneuvonta). EU consumers may also use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. You may also bring proceedings before the competent courts of the jurisdiction where you reside.

11. Changes to These Terms

We reserve the right to modify these Terms. When we make material changes, we will notify you by reasonable means (such as updating the "Last updated" date at the top of this page or notifying you via the Service) at least 30 days before the changes take effect. Continued use of the Service after the changes take effect constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the Service.

12. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
